Any reliance you place on such information is therefore strictly at your own risk. In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.
Through this website, you may be able to link to other websites which are not under the control of Smailander. We have no control over the nature, content, and availability of those sites. 2. Domain Sale Disclaimer
The domain "smailander.com" is being offered for sale through Sedo.com, a third-party domain marketplace. The acquisition transaction is governed by Sedo's terms of service, escrow process, and dispute resolution mechanisms. Smailander (the current owner) is not responsible for:
- Transaction Security: Any issues related to payment processing, fraud detection, or escrow services provided by Sedo. These matters are exclusively handled by Sedo's secure payment system.
- Domain Transfer Issues: Technical difficulties or delays in domain transfer between registrars, which are subject to ICANN policies and individual registrar terms.
- Codebase Delivery: The source code and credentials will be delivered via email to the buyer's email address provided in the Sedo transaction. Smailander is not responsible for email delivery failures, spam filters, or recipient email issues.
- Code Functionality: The source code is provided "as-is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. No technical support, updates, or maintenance is guaranteed unless explicitly agreed upon in writing.
- Hosting Services: The 3 months of free hosting is provided on a best-effort basis and may be terminated at any time without prior notice. No uptime guarantees or service level commitments are made for this complimentary period.
- Infrastructure Dependencies: The platform's dependencies on third-party services (SMTP providers, cloud infrastructure, APIs) may require separate licensing or subscription fees paid by the buyer after acquisition.
The buyer acknowledges that they are acquiring a startup project in early development stage and assumes all responsibility for future development, maintenance, legal compliance, and operational costs.
3. Data Collection & GDPR Compliance
Smailander is committed to protecting the privacy and personal data of individuals in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.
Data We Collect
- Email Data: Emails sent to honeypot addresses are collected for security monitoring and threat analysis purposes. This includes sender information, email headers, content, and attachments.
- Metadata: IP addresses, timestamps, geographic location data, SMTP server information, and technical communication details.
- User Account Data: For registered users, we collect name, email address, and authentication data necessary for account access.
- Analytics Data: Website usage data, session information, and interaction patterns for platform improvement.
Legal Basis for Processing
- Legitimate Interest: Email honeypot monitoring is conducted for legitimate security research, threat intelligence, and cybersecurity defense purposes (Article 6(1)(f) GDPR).
- Contractual Necessity: User account data is processed to fulfill contractual obligations for service provision (Article 6(1)(b) GDPR).
- Legal Obligation: Certain data may be retained for compliance with legal obligations, including potential law enforcement requests (Article 6(1)(c) GDPR).

4. Data Retention Policy
Smailander retains personal data and email data only for as long as necessary for the purposes outlined in this policy and in accordance with legal requirements.
Retention Periods
- Email Data: Emails and associated metadata are retained for 180 days (6 months) for security monitoring and threat analysis purposes. After this period, data is permanently deleted or anonymized.
- User Account Data: Retained while your account is active. Deleted within 30 days of account termination, unless retention is required for legal purposes.
- Analytics Data: Website and usage analytics retained for 365 days (1 year) for platform improvement and security analysis.
- Backup Data: System backups are retained for 90 days. Backups are encrypted and stored securely.
- Threat Intelligence Data: May be retained indefinitely in anonymized form for pattern recognition and threat database building, with all personally identifiable information removed.
Data Deletion
Upon expiration of retention periods, data is securely deleted using industry-standard methods that render data unrecoverable. Anonymized data may be retained for statistical or security research purposes.
Important: Certain data may be retained beyond standard periods if required by law, court order, or for legitimate security interests. We will notify affected individuals of any extended retention when legally required.
5. Service Level Agreement (SLA)
This Service Level Agreement applies to paid subscription tiers (Professional and Enterprise plans). The Starter plan and demo dashboard are provided without SLA guarantees.
Uptime Commitment
- Professional Plan: 99.5% monthly uptime commitment (up to 3.65 hours of downtime per month).
- Enterprise Plan: 99.9% monthly uptime commitment (up to 43.2 minutes of downtime per month).
Exclusions from SLA
- Scheduled maintenance windows (announced at least 24 hours in advance)
- Force majeure events (natural disasters, wars, terrorist attacks, etc.)
- Third-party service failures (SMTP providers, cloud infrastructure, DNS providers)
- Customer-side network or connectivity issues
- Unplanned emergency maintenance for critical security patches (without prior notice)
SLA Credits
If uptime falls below committed levels, customers may be eligible for service credits:
- Below 99% uptime: 10% service credit
- Below 98% uptime: 25% service credit
- Below 95% uptime: 50% service credit
- Below 90% uptime: 100% service credit
Service credits are calculated on a monthly basis and applied to future invoices. Credits do not exceed the monthly subscription fee.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Smailander shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Security Failures: Failure to detect all phishing attempts, malware, or threats. No security system can guarantee 100% threat detection.
- Email Delivery: Loss or corruption of emails during transmission, storage, or processing.
- False Positives/Negatives: Incorrect classification of emails as spam, threat, or benign. Users are responsible for reviewing and verifying threat classifications.
- System Downtime: Unavailability of services, even if it results in business interruption or loss.
- Data Breaches: Security incidents, data breaches, or unauthorized access, despite implementation of reasonable security measures.
- Third-Party Actions: Actions or inactions of third parties, including email senders, SMTP providers, or cloud service providers.
- Domain Sale: Issues arising from domain acquisition, including but not limited to domain transfer failures, code delivery issues, or post-acquisition operational problems.
Maximum Liability: Smailander's total liability for any claims arising from or related to the use of services or domain acquisition shall not exceed the amount paid by the customer in the preceding 12 months, or USD $1,000, whichever is greater.
7. Indemnification
You agree to indemnify, defend, and hold harmless Smailander, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the services using your account.
Specific Indemnification Scenarios
- Unauthorized Access: Damages resulting from compromised account credentials due to user negligence.
- Legal Violations: Violation of applicable laws or regulations, including but not limited to data protection laws, telecommunications regulations, or cybersecurity laws.
- Third-Party Infringement: Infringement upon the intellectual property rights or privacy rights of third parties.
- Misuse of Data: Use of collected threat intelligence or platform data for malicious, illegal, or unauthorized purposes.
- Domain Misuse: Post-acquisition misuse of the domain or codebase for illegal activities, fraud, or malicious purposes.
